TERMS OF PUBLIC OFFER

For sale of hair products, cosmetics, professional salon goods, equipment and custom orders via online store babyhair.com.ua

This document is a public offer (the “Agreement”). By placing an order on the website, the Customer fully accepts the terms set out below.

1. GENERAL PROVISIONS

1.1. This Public Offer Agreement, hereinafter referred to as the “Agreement” or the “Offer”, constitutes an official public offer of the Seller, carrying out the sale of goods through the Baby Hair online store, located at https://www.babyhair.com.ua/, hereinafter referred to as the “Website” or the “Online Store”, to conclude a distance contract for the sale of goods and/or a contract for the performance of custom orders.

1.2. The Seller operates an online store specializing in:

human hair extensions, natural and synthetic hair products;
wigs, hairpieces, toppers, braids, wefts, clips-in hair extensions;
hair care cosmetics (shampoos, masks, conditioners, oils, serums, sprays, styling products, dyes);
professional salon tools and equipment (hair dryers, straighteners, curling irons, clippers, trimmers, brushes, combs, accessories);
consumables and salon supplies;
related professional and consumer beauty products.

1.3. This Agreement is governed by:

applicable laws of Ukraine (as primary jurisdiction);
and, where applicable, mandatory consumer protection laws of the Customer’s country (including EU/EEA and UK consumer regulations).

1.4. The English version of this Agreement is provided for international convenience. The Ukrainian version shall prevail in case of any discrepancies.

1.5. By placing an order, the Customer confirms that they have read, understood and accepted this Agreement.

2. DEFINITIONS

2.1. “Customer” — any individual, entrepreneur or legal entity placing an order via the Website.

2.2. “Goods” include, but are not limited to:

hair extensions, wigs, hairpieces, bundles, strands, tapes, clips, toppers;
cosmetic hair care products and chemical products;
professional salon tools and electrical equipment;
accessories, consumables and related products.

2.3. “Cosmetic Products” — shampoos, conditioners, masks, oils, styling products, dyes, bleaches, oxidizers and similar items.

2.4. “Professional Products” — goods intended for salon or professional use.

2.5. “Custom Order” — any modification or production based on customer specifications (color matching, length adjustment, custom preparation, assembly, etc.).

2.6. “Order” — request placed by Customer through Website, email, messenger or other agreed communication channels.

2.7. “Carrier” — postal or courier service including national and international delivery providers.

3. SUBJECT OF AGREEMENT

3.1. The Seller agrees to supply Goods and/or perform Custom Orders, and the Customer agrees to pay and accept them under this Agreement.

3.2. Product description, price, availability, delivery terms and specifications are defined on the Website or confirmed individually.

3.3. The Seller reserves the right to clarify product specifications before confirming an Order.

3.4. Minor variations in color, texture, packaging or appearance may occur due to lighting, screen settings or product batch differences.

4. ORDERING PROCESS

4.1. Orders are placed via Website or Seller’s communication channels.

4.2. The Customer must provide accurate delivery and contact information.

4.3. An Order is confirmed once availability, price and delivery terms are accepted by the Seller.

4.4. If Goods are unavailable or cannot be delivered, the Seller may offer replacement, delay or refund.

4.5. Custom Orders are confirmed only after mutual agreement of specifications.

4.6. Production of Custom Orders may require advance payment.

5. PRICES AND PAYMENT

5.1. Prices are listed on the Website or agreed individually.

5.2. Prices are fixed after Order confirmation.

5.3. Payment methods may include:

bank transfer;
online payment systems (Stripe, PayPal or similar);
cash on delivery (where available);
other agreed methods.

5.4. All payments are made in the currency indicated on the Website or invoice.

5.5. The Customer is responsible for all transaction fees, bank charges, customs duties and import taxes (if applicable).

6. DELIVERY

6.1. Delivery is available domestically and internationally.

6.2. Delivery times are approximate and depend on logistics providers and customs procedures.

6.3. The Seller is not responsible for delays caused by carriers, customs or force majeure.

6.4. For international orders, the Customer is the importer of record and is responsible for compliance with import regulations of their country.

6.5. If the Customer fails to collect the parcel, all return and storage costs are borne by the Customer.

7. INSPECTION OF GOODS

7.1. The Customer must inspect the parcel upon receipt.

7.2. In case of visible damage, the Customer must file a claim with the carrier and notify the Seller.

7.3. Acceptance without objections does not waive statutory rights regarding hidden defects.

8. RETURNS, REFUNDS AND RIGHT OF WITHDRAWAL

8.1. Returns are governed by applicable consumer protection laws.

8.2. Where required by law (including EU/EEA/UK distance selling rules), the Customer may have the right to withdraw from the purchase within 14 days of receiving the Goods.

8.3. The right of withdrawal does NOT apply to:

opened or used cosmetic products;
hygiene-related goods;
hair extensions, wigs or hairpieces once unpacked or used;
custom-made or personalized Goods;
products that cannot be resold for hygiene reasons.

8.4. Returned Goods must be unused, in original packaging and in resellable condition (where return is legally permitted).

8.5. The Seller may refuse return if goods show signs of use, damage or hygiene breach.

8.6. Refunds are processed using the original payment method unless otherwise agreed.

9. COSMETICS, HAIR PRODUCTS AND PROFESSIONAL USE

9.1. The Customer acknowledges that hair products, cosmetics and chemical formulations require proper use strictly according to manufacturer instructions.

9.2. The Seller is not responsible for results caused by:

incorrect application;
allergic reactions or individual sensitivity;
misuse or mixing with other products;
professional procedures performed incorrectly.

9.3. Professional products are intended for trained users only.

10. ELECTRICAL EQUIPMENT

10.1. Electrical goods must be used according to manufacturer instructions and safety standards.

10.2. Warranty applies only if provided by manufacturer or explicitly stated.

10.3. Damage caused by misuse, moisture, drops or unauthorized repair is not covered.

11. PERSONAL DATA

11.1. The Customer agrees to processing of personal data for order fulfillment, delivery, payment processing and legal compliance.

11.2. Data may be shared with logistics providers, payment systems and service partners only as necessary.

12. INTELLECTUAL PROPERTY

12.1. All content on the Website is protected by intellectual property laws.

12.2. Copying or unauthorized use is prohibited.

13. LIABILITY AND FORCE MAJEURE

13.1. The Seller is not liable for indirect losses or improper use of Goods.

13.2. The Seller is not responsible for carrier delays, customs issues or external factors.

13.3. Force majeure includes war, natural disasters, government restrictions, transport disruption and similar events.

14. DISPUTE RESOLUTION

14.1. Parties will attempt to resolve disputes amicably.

14.2. If not resolved, disputes shall be governed by applicable law and resolved in competent courts.

15. CHANGES TO TERMS

15.1. The Seller may update this Agreement at any time.

15.2. The updated version becomes effective upon publication on the Website.
